“Limited Warranty” – 1 Year(All Models)
Foster Manufacturing Corporation warrants to the original purchaser of each new product sold under the “FOSTER” trademark or bearing the name Foster Manufacturing Corporation that it will repair or replace, as Foster Manufacturing Corporation elects, any part of such product which is defective in material or workmanship as delivered to the purchaser, if the defect appears within 1 Year from date of purchase. If Foster Manufacturing Corporation elects to repair the product; such repair will be made without charge to the purchaser for parts or labor.
-TO OBTAIN WARRANTY SERVICE-
Product must be taken, together with proof of original purchase date, at your expense to a “Foster” dealer or distributor authorized to sell the “Product” during their normal business hours. Servicing dealer or distributor must follow the outlined procedure. If Dealers or Distributors are not available contact factory.
The servicing dealer or distributor must get authorization from Foster Manufacturing Corporation before any warranty service.
Obligation under this warranty is limited to repair or replacement of parts that the manufacturer determines to be defective.
Engines, Motors and other purchased components not manufactured by Foster are warranted by respective manufacturer of the specific product.
Warranty does not extend to parts affected or damaged by collision, misuse, neglect, parts worn beyond service limits due to normal wear/normal service life, or operation related to inferior hydraulic fluids, quantities or contaminations. The incorporation of or use of unsuitable attachments or parts, the unauthorized alteration of any part or any causes other than defects in material or workmanship of the Foster Products.
Foster Manufacturing Corporation is not liable for warranty service. Transportation expenses incurred between the customer and dealer or factory is not the responsibility of Foster Manufacturing.
Product or parts may not be returned without prior authorization for which Foster Manufacturing Corporation will issue a R.G.A. number.
In keeping with our policy of constant improvements, we reserve the right to change our specifications or design at any time.

LIMITATION OF LIABILITY
Except as otherwise agreed herein, Foster Manufacturing Corporation shall not be liable for special, incidental or consequential damages arising out of the use of, or inability to use, any product sold by Foster Manufacturing, including, without limitation, damaged or loss of other property or equipment, loss of profits or revenues, or claims of customers or customer for any such damage or loss.
The remedies of customer set forth herein are exclusive, and the liability of Foster Manufacturing Corporation with respect to any contract, or anything done in connection therewith, such as performance or breach thereof or for the manufacture, sale, delivery, resale, installation or technical direction of installation, repair or use of any product sold by Foster Manufacturing Corporation, whether in contract, in tort, under any warranty or otherwise, shall not, except as expressed by provided herein, exceed the price of the product(s) or part(s) upon which such liability is based. The price for the product(s) sold by Foster Manufacturing Corporation is the consideration given by Foster Manufacturing Corporation in limiting its liability hereunder.
